Before you start

  • Proposed owners, operating state, business address and real services.
  • A proposed legal name and any trade name.
  • Access to official state registration and IRS guidance.

What you will finish with

  • An ownership and professional-advice question list.
  • A setup record with official filing references and renewal tasks.
  • An EIN confirmation retained securely for banking and tax administration.

Decide who owns the business and what decisions need professional help

Begin with who owns the business, who can sign, how decisions are made and what happens when an owner leaves. These facts help a qualified adviser explain suitable legal and tax choices.

Sole proprietorship, LLC, partnership and corporation

Compare sole proprietorship, limited liability company (LLC), partnership and corporation using questions about ownership, administration, contracts and risk. No entity recommendation is generated by this worksheet.

Liability and tax choices are separate questions

Entity formation and tax treatment are related but separate decisions. Ask a qualified legal or tax professional about the actual owners and operation; do not infer tax savings or complete personal protection from an LLC label.

Check the name and register with the correct authority

Use the authority for the actual filing. A name search, entity filing and local operating registration can be different processes.

State name search and DBA

Check the state's name search and ask where a doing-business-as (DBA), or trade name, must be registered. A web domain or social account does not establish authority to use a business name.

Formation documents and registered-agent requirements

Follow the state's current formation and registered-agent requirements for the selected entity. Record filed documents, confirmation, actual fees and ongoing responsibilities from the official source.

Local business registration is separate

Ask the city/county about local business registration, zoning and the operating location. Formation through the state does not complete all job or trade requirements.

Apply for an EIN directly through the IRS

An employer identification number (EIN) is a federal tax identifier. Apply through the IRS's official route and use its current instructions for eligibility and method.

Who needs one and responsible-party information

Review the IRS guidance on whether your operation needs an EIN and which responsible-party information is required. Supply identifiers only through the official secure process, never in this guide's worksheet.

Form the entity first where applicable

The IRS directs businesses creating an LLC or corporation to form it through the state before applying. Use the formed entity's accurate legal information.

Save the confirmation securely

Retain the IRS confirmation in controlled business records and record where it is kept, not the identifier itself, in the public checklist. Share documents with the bank or adviser through their secure channels.

Make a business setup record

Create a setup record that someone else can maintain. Each task should have an authority, a responsible person, an evidence reference and a renewal or review trigger.

Consistent legal name/address

Use the same verified legal name, address and ownership information on formation, banking, tax and customer records. Investigate differences rather than inventing a second identity for a form.

State filing, renewal and employer/tax registrations

Track state renewals, employer and tax registrations, trade-license questions and local permits separately. Use actual official dates and fees; this guide publishes no universal state fee.

Handoff to the bank and bookkeeper

Ask the selected bank for its document checklist and the bookkeeper for an opening-record checklist. Record contributions, opening balances and where the supporting documents are stored.

Avoid preventable setup errors

Avoid shortcuts that create duplicated filings or unnecessary disclosure. Save official confirmations and a task log so a later adviser can see what was actually done.

Paid EIN intermediaries

The IRS EIN application is free as of 2026-10-11. A third party may charge for its assistance, but that charge is not an IRS application fee.

Treating an LLC as complete insurance or personal protection

Discuss actual liability, contracts and coverage with qualified professionals. Forming an entity does not replace insurance, safe work practices or compliance with trade rules.

Sharing sensitive identifiers

Keep Social Security numbers, EINs and tax documents out of public forms, emails without suitable safeguards, screenshots and this worksheet. Record document locations and task status instead.

Collect and complete official setup and EIN records

  1. Record owners and activity

List real owners, services, location, proposed names and the entity/tax questions requiring advice.

  2. Find the official filing route

Open the selected state's authority and confirm name, entity, DBA and registered-agent requirements.

  3. Save formation evidence

Complete applicable filings through the authority and store confirmations and renewal tasks securely.

  4. Follow the IRS EIN instructions

Check eligibility and responsible-party requirements; if creating an LLC or corporation, form it first and apply directly through the IRS.

  5. Complete the handoff

Retain the confirmation securely, collect the bank/bookkeeper document requirements and record remaining local or employer checks.

Frequently asked questions

Do I need an LLC to start?

An LLC is one possible entity, not a universal requirement or recommendation. Compare the actual owners, risk, administration and tax questions with qualified help.

Can I use a trade name?

Check the state's and locality's DBA or assumed-name process for your entity and location. A name used in advertising still needs to be consistent with applicable registrations.

Does an EIN cost money when I apply through the IRS?

The IRS direct EIN application is free as of 2026-10-11. Use the official IRS link; a paid intermediary's service charge is separate.

Should I register the entity before applying for an EIN?

The IRS says to form an LLC or corporation through the state before applying. Follow its current instructions for your actual entity and application method.

Does registration replace a contractor license?

No. Check entity/DBA registration, trade licensing, employer registrations and job permits separately for the actual work and location.

What records will the bank ask for?

Ask your chosen bank for the current checklist for your entity. It may request identification, tax identification and formation/ownership documents; transfer them through the bank's secure process.

What needs updating if ownership or the business name changes?

Review state, IRS, bank, licensing, contracts and coverage records with the appropriate authority or professional. Ask the IRS whether the actual change requires a new EIN rather than assuming the existing number always applies.
